James Comey, the former director of the FBI, has entered a not guilty plea to charges of making false statements to Congress and obstructing a congressional proceeding. His attorney, Patrick Fitzgerald, submitted the plea in a federal court in Alexandria, Virginia, on Wednesday. Fitzgerald indicated an intention to seek a dismissal of the case, suggesting that Comey was being targeted due to his criticisms of former President Donald Trump.
Comey’s indictment occurred shortly after Trump urged his attorney general to pursue action against him. A trial date has been set for January 5, following a request from Comey’s legal team for a speedy trial. Both sides anticipate the trial will last between two to three days. Fitzgerald stated that multiple motions to dismiss the case will be filed, arguing that the prosecution was vindictive and that a US attorney had been unlawfully appointed to oversee the case, replacing Erik Siebert, who resigned under pressure from Trump after his investigation into another political adversary did not yield charges.
During the court appearance, Comey appeared relaxed, accompanied by his wife and daughter, and acknowledged the charges presented by the judge. Each charge carries a possible penalty of up to five years in prison and a fine of $200,000.
Lindsey Halligan, the current federal prosecutor in Virginia, secured the indictment against Comey after previous prosecutors deemed the case insufficient due to a lack of evidence. This led to concerns from Comey’s defense about access to classified documents that the prosecution planned to use as evidence. Judge Michael Nachmanoff cautioned the government to ensure timely sharing of information and indicated that procedural delays would not hinder the case.
The charges stem from allegations that Comey provided misleading testimony during a Senate Judiciary Committee hearing in September 2020 regarding the investigation into Russian election interference and the inquiry into Hillary Clinton’s email server. Comey has publicly maintained his innocence, indicating his willingness to proceed to trial. The legal proceedings follow Trump’s vocal calls for Comey’s prosecution on social media.
