The Supreme Court is Google’s last hope to avoid an Epic reckoning in October

Google has entered into an agreement with certain stipulations that will remain in effect until November 1, 2027. During this period, Google is prohibited from sharing revenue generated by the Google Play Store with any individual or organization that distributes Android apps or is planning to launch an alternative Android app distribution platform or store.

Additionally, for the same three-year duration, Google cannot tie payments or revenue-sharing agreements to app developers based on conditions that require them to launch an app exclusively in the Google Play Store. Relatedly, Google may not condition its services or payment structures on app developers agreeing not to launch alternative versions of their apps on third-party platforms that may have different features than those offered on the Google Play Store.

Google is also restricted from mandating that original equipment manufacturers (OEMs) or carriers preinstall the Google Play Store in specific locations on Android devices as a condition for payment or access to services. Furthermore, developers are not required to use Google Play Billing for in-app purchases on the Google Play Store. They may also communicate about and utilize alternative payment methods without restrictions from Google, including informing users about pricing or the availability of the app outside the Google Play Store.

To facilitate the resolution of related disputes or technological issues, a three-person Technical Committee is to be recommended to the Court by the involved parties within thirty days of the order. This committee will consist of members chosen by both Epic and Google, with a third member selected by the first two. If disputes arise that the committee cannot resolve, the parties have the option to seek court intervention. The costs for committee members will be shared by the respective parties involved.
